On the afternoon of 17 October 2023, the “Public Prosecution System and Dispute Resolution in China” Practice Workshop Hong Kong delegation visited the Beijing Arbitration Commission / Beijing International Arbitration Center (the “BAC”). Dr. Jiang Lili, Secretary General of the BAC, welcomed the delegation, and had exchanges with the delegation on the latest practice of dispute resolution in mainland China.

During the meeting with the delegation, Dr. Jiang firstly expressed warm welcome to the guests. She presented a detailed introduction of the BAC’s international arbitration development, statistics of the BAC’s arbitrators, exchanges and cooperation between the BAC and its Hong Kong partners. She pointed out that this meeting with the “Public Prosecution System and Dispute Resolution in China” Practice Workshop Hong Kong delegation is a follow-up event of the national development strategy, and also an important opportunity of strengthening the exchanges and cooperation between mainland China and Hong Kong. Hong Kong has extensive advanced experiences in the realm of arbitration. With the new amendment to the PRC Arbitration Law, there will be more exchanges and cooperation concerning arbitration between mainland China and Hong Kong. Meanwhile, a new round of systematical reform has commenced after the inauguration of the 8th Committee of the BAC , which will further promote the BAC to have internationalized, legalized and market-oriented development, and will also promote the construction of the Beijing international arbitration hub. The BAC is willing to strengthen its exchanges and cooperation with Hong Kong legal professionals, and jointly enjoy the opportunity and benefits of development.
Dialogue between BAC and the delegation
Ms. Yang Lilian, Deputy Director of the Hong Kong, Macau and Taiwan Affairs Office of National Prosecutors College, provided an introduction of the “Public Prosecution System and Dispute Resolution in China” practice workshop. The workshop was held by the Legal Dept. of the Liaison Office of the Central People’s Government in the Hong Kong SAR, and all the participants are Hong Kong solicitors, barristers, in-house counsels and other relevant professionals within the area of industry and commerce. Ms. Yang expected the meeting could promote the practical exchanges on dispute resolution between Hong Kong professionals and their colleagues in mainland China, and also promote Hong Kong legal professionals to have in-depth understanding of the latest achievements of the legal construction in mainland China.

Thereafter, Mr. Yin Tong, Senior Counsel of BAC Business Development Division (International Arbitration Division), presented an introduction to the guests the BAC’s key statistics in arbitration case types, composition of the parties, efficiency of case hearing and so forth, as well as the BAC’s practice of emergency arbitrator and the amendment to its arbitration rules. During the Q&A session, the delegation members raised questions proactively. Dr. Jiang answered their questions and had in-depth exchanges with them on both theoretical and practical issues such as the BAC’s practice of international cases, the selection of arbitrators and mediators, the reliefs against arbitral awards, the negotiations of dispute resolution clauses and the construction of international arbitration center.
