High-Level Dialogue between the BAC/BIAC Delegation and JAMS on International Dispute Resolution in New York

 On June 29, Dr. Jiang Lili, the Secretary-General and Committee Member of the Beijing Arbitration Commission/Beijing International Arbitration Center (BAC/BIAC), led a delegation to host a high-level international commercial arbitration cooperation dialogue with JAMS, the largest private ADR provider in the United States, at JAMS office in New York.  Mr. Matthew York, Vice President of JAMS, along with staff members, arbitrators, legal professionals from the New York office, and representatives from the West Coast and London, participated in this constructive and friendly dialogue with the BAC/BIAC in a hybrid format.


 Mr. Matthew York warmly welcomed the BAC/BIAC delegation and provided an overview of JAMS development.  Founded in 1979, JAMS is the world’s largest private ADR service provider, with a panel of over 400 retired state and federal court judges, lawyers, and other ADR professionals.  JAMS deals with approximately 18,000 cases annually, covering the jurisdictions across the United States and of others worldwide. Mr. York expressed an expectation to take this dialogue an opportunity to further strengthen the cooperation between JAMS and the BAC/BIAC in the fields of international arbitration and mediation, establishing a regular communication mechanism for collaboration and mutual learning, and jointly providing high-quality and efficient international arbitration and mediation services for the users.

 Dr. Jiang Lili highlighted the BAC/BIAC achievements and business overview, focusing on the progress and support measures for the International Commercial Arbitration Hub (Beijing).  She emphasized the commitment of the BAC/BIAC to a diversified approach, aiming to create a globally-oriented International Commercial Arbitration Hub that attracts parties and legal professionals worldwide to choose Beijing as their destination for arbitration.  The BAC/BIAC, in collaboration with other Beijing-based arbitration institutions in Beijing, is supporting the establishment of the Beijing International Dispute Resolution Center, which will provide professional and high-quality dispute resolution services to international organizations, institutions, and individuals.

 The BAC/BIAC and JAMS discussed the development and construction of arbitration and mediation institutions in China and the United States, the systems and cultures of arbitration and mediation, the coordination and transition of arbitrators and mediators, and the mechanisms for cooperation.  They agreed that there is a converging trend in the integration and promotion of arbitration and mediation between the two jurisdictions.  Different combinations of arbitration and mediation, suited to various dispute resolution scenarios, represent the future trend of dispute resolution.  Based on this consensus, the two sides should exchange and cooperate on the specific rules and procedures, and practical experiences, to provide the parties with the best solution for mutual benefits that resolve disputes and address conflicts at their source.  Together, the two sides also fondly recalled the filming years of the first arbitration documentary “Arbitration in China” initiated by the China Arbitration Institute of the China University of Political Science and Law at JAMS in 2018. Dr. Jiang Lili expressed her gratitude to JAMS for their friendly cooperation and support. The BAC/BIAC Division Chief Mr. Sun Yu and the Case Manager Ms. Zhao Hanqing participated the dialogue.

Following the conversation, the BAC/BIAC delegation, guided by the JAMS team, had a site tour visiting the modern hearing rooms and facilities of JAMS. The two sides further had an in-depth exchange on improving user-friendly dispute resolution service rules, environments, and facilities.

All disputes arising from or in connection with this contract shall be submitted to Beijing Arbitration Commission / Beijing International Arbitration Center for arbitration in accordance with its rules of arbitration. The arbitral award is final and binding upon both parties.
