The Secretary General Dr. Jiang Lili and the BAC/BIAC Delegation Visit the International Centre for Dispute Resolution of the American Arbitration Association

On June 28, 2024, the BAC/BIAC delegation, led by Dr. Jiang Lili, the Secretary General and Committee Member of the Beijing Arbitration Commission/Beijing International Arbitration Center (BAC/BIAC), visited the International Centre for Dispute Resolution of the American Arbitration Association (AAA-ICDR) while attending the 57th session of the UNCITRAL Commission.  The BAC/BIAC delegation and the AAA-ICDR held a seminar on international commercial arbitration practices at the AAA-ICDR office in New York.  Mr. Luis Martinez, Vice President of the AAA-ICDR, along with several arbitrators and legal professionals, engaged in a friendly communication with the BAC/BIAC delegation.

Mr. Luis Martinez warmly welcomed Dr. Jiang Lili and her delegation.  He mentioned that the AAA is a time-honored and influential arbitration institution in the United States, approaching its 100th anniversary in 2026.  In 1996, the ICDR was established as a division of the AAA for handling international disputes.  In 2023, the AAA caseload has exceeded 500,000 for the first time, of which 848 are the international cases registered with the ICDR with the sum of dispute amounting to a total of $5 billion.  China is the largest country of origin where the ICDR international parties are from.  In 2023, the ICDR cases has involved 174 Chinese parties.  Mr. Martinez expressed that AAA-ICDR is willing to further strengthen exchanges and cooperation with the BAC/BIAC to jointly promote the development of international arbitration and dispute resolution services.

In her keynote speech, Dr. Jiang Lili introduced the development history and business overview of the BAC/BIAC.  She addressed the questions from the attendees regarding the handling of international cases, standards for the selection of foreign arbitrators, considerations for the constitution of tribunal, and the recognition and enforcement of awards in Beijing.  She also introduced the promotive measures for the construction of the International Commercial Arbitration Hub in Beijing.  Dr. Jiang emphasized that the BAC/BIAC adheres to an open and inclusive international development path and fully supports the construction of Beijing International Commercial Arbitration Hub.  The BAC/BIAC, along with other arbitration institutions in Beijing, supports the establishment of the Beijing International Dispute Resolution Center, which provides professional and high-quality services for international organizations and individuals to conduct arbitration hearings, meetings, exchanges, research, and training related to dispute resolution in Beijing.

Subsequently, members of the BAC/BIAC delegation and American participants exchanged views and had in-depth discussions on the application process for arbitrators in China and the US, training programs, appointment procedures, disclosure rules, online hearings, and the female arbitrators’ participation in case handling.  Both parties agreed that the arbitration industries in China and the US are confronting with identical practical issues and should establish a regular exchange and cooperation mechanism.  The BAC/BIAC delegation members Ms. Wu Wendi, Mr. Sun Yu, and Ms. Zhao Hanqing, also attended the seminar.

Following the seminar, the AAA hosted a reception for the BAC/BIAC delegation.  All attendees actively participated and further exchanged and discussed the seminar content in a pleasant and in-depth manner during the reception.

All disputes arising from or in connection with this contract shall be submitted to Beijing Arbitration Commission / Beijing International Arbitration Center for arbitration in accordance with its rules of arbitration. The arbitral award is final and binding upon both parties.
