On November 11, 2024, Dr. Jiang Lili, the Secretary-General and Committee Member of the Beijing Arbitration Commission/Beijing International Arbitration Center (BAC/BIAC) and the BAC/BIAC delegation, visited the Japan Commercial Arbitration Association (JCAA). JCAA President Shinsuke Kitagawa and others hosted the visit, both parties had an in-depth exchange on the current business and main progress of their respective institutions as well as future cooperation.
Dr. Jiang Lili introduced the development achievements and operation profile of the BAC/BIAC, as well as highlighting the innovative attempts taken to offer professional and efficient dispute resolution services for international parties. She stated that the BAC/BIAC is committed to a diverse and integrated development path, focusing on building an international commercial arbitration center serving the global community. Together with the other arbitration institutions in Beijing, the BAC/BIAC has supported the establishment of the Beijing International Dispute Resolution Center (BIDRC), which aims to foster holistic and collaborative growth across the arbitration sector and the broader legal services industry.
Shinsuke Kitagawa warmly welcomed the BAC/BIAC delegation and provided an introduction to JCAA. JCAA is committed to providing diversified, efficient, and flexible arbitration services, and enforceable arbitration awards. JCAA is also working to improve its commercial mediation rules. With the revision of Japan Arbitration Act in 2024, innovative measures such as expanding the scope of arbitrability to uphold the validity of arbitration agreements, and allowing courts to enforce arbitral tribunal interim measures, have not only enhanced Japan's position in international arbitration but also further improved the level of arbitration services and the professionalism of courts in the arbitration field.
The BAC/BIAC delegation and the JCAA representatives conducted an in-depth discussion on the status quo, challenges, and development prospects of the arbitration industry, sharing their experiences and practices in arbitration case handling and arbitration system innovation. Both agreed that arbitration institutions should actively align with international best practices, meet the evolving demands of global economic and trade, and promote the development of professional expertise in international arbitration and mediation in the process of establishing an international commercial arbitration hub, and establish a more open and internationally oriented dispute resolution mechanism.
Dr. Jiang Lili and Shinsuke Kitagawa signed the Memorandum of Understanding for Cooperation (MOU) on behalf of their respective institutions. According to the MOU, the BAC/BIAC and JCAA will deepen their cooperation in exchanging international case management experience, international arbitration researches and publications, arbitrator referral, and arbitration facility sharing. The signing of this MOU is an important attempt for the BAC/BIAC to strengthen international exchange and cooperation and enhance its international influence. Both sides will take the signing of this MoU as an opportunity to improve the cooperative mechanism, to achieve resource sharing and complementary advantages, and to jointly help Beijing and Tokyo to build an international commercial arbitration hub.
