On the afternoon of March 3, 2025, the “International Arbitration Salon: Interpreting the Role of ‘Practice Guidelines’ in Chinese Arbitration Practice,” hosted by the Beijing Arbitration Commission/Beijing International Arbitration Court (hereinafter referred to as “BAC/BIAC”), was successfully held in the BAC/BIAC International Conference Hall.
Prior to the event, Mr. Felix Dasser, President of the Swiss Arbitration Association, engaged in discussions with BAC/BIAC’s Chairperson Mr. Guo Wei and others. Mr. Guo Wei recalled the excellent cooperative relationship and close practical arbitration exchanges between BAC/BIAC and the Swiss Arbitration Association, while Mr. Felix Dasser highly praised BAC/BIAC’s innovative arbitration practices and contributions to advancing international arbitration. Both parties expressed their hopes to further collaborate on issues such as rule innovation, mutual recommendation of arbitrators, joint training, and more.
Special Topic Seminar
BAC/BIAC Committee Member and Secretary-General Dr. Jiang Lili delivered an opening speech. During the Q&A session, BAC/BIAC Committee Member Dr. Jin Hui discussed with Mr. Felix Dasser how Chinese experts can participate in the formulation of international rules.
Dr. Jiang Lili noted that “Practice Guidelines” have become a central topic in international arbitration. BAC/BIAC has developed several guidelines including: Guidelines on Currencies and Their Interest and Exchange Rates in International Arbitrations, Standard Format Guidelines for International Arbitration Awards, Operational Guidelines on Calculating Arbitrator's Remuneration with Hourly Rates, Self-Inspection Checklist for Emergency Arbitrators. The formulation and refinement of these Practice Guidelines actively respond to the parties’ practical needs for an economical, convenient, and efficient resolution of commercial disputes. They ensure that fairness and efficiency go hand in hand, playing an important role in maintaining the orderly development of the arbitration industry and enhancing arbitration credibility. BAC/BIAC remains committed to working with experts from various industries to jointly analyze common issues in arbitration practice, reach consensus, and promote overall industry development. BAC/BIAC will continue to strive towards building a world-class arbitration institution and supporting the development of the international commercial arbitration center, improving its diversified dispute resolution services and contributing Chinese arbitration wisdom to the global market.
The panel discussion was moderated by Dr. Dong Xiao, a partner at JunHe Law Firm. Mr. Felix Dasser first shared with the attendees the application of “Practice Guidelines” in international arbitration, discussing the core disputes and judicial responses related to widely used guidelines such as the IBA Rules on the Taking of Evidence, the Prague Rules, and the IBA Guidelines on Conflicts of Interest. He suggested that future guidelines might address new issues such as third-party funding, the connection between arbitration and mediation, and the application of emerging technologies. He also encouraged Chinese arbitration institutions and legal practitioners to actively participate in formulating relevant “Practice Guidelines,” to voice the Chinese perspective, and to contribute Chinese wisdom to international arbitration practice.
Subsequently, the attendees engaged in a lively discussion on topics including “the binding nature of the Practice Guidelines” and “how to apply the Practice Guidelines in arbitration practice,” adding rich academic depth and practical value to the salon.
