[Abstract] Guiding case No. 25 is a dispute over the subrogation right of the insurer between Beijing branch of Huatai P&C Insurance Company and LI Zhigui, as well as Zhangjiakou sub-branch, Hebei branch, Tianan Property Insurance Company. Key judgment points: where the insurance accident is caused by the damage on the object of insurance by the third party, after the insurer having compensated the insured the premium and filed a litigation for subrogating the insured to claim compensation against the third party, the legal relationship between the insured whose right is subrogated and the third party shall be applied to determine the competent court rather than the legal relationship in the insurance contract. The infringement of the third party upon the legal rights and interests of the insured shall be under the jurisdiction of the court of the place where the tort is committed or where the defendant has his domicile.
