经过近半年紧锣密鼓地筹备,“常设中国建设工程法律论坛”于2017年6月14日完成章程签署,正式宣告成立。
常设中国建设工程法律论坛( “The Permanent Forum of China Construction Law”,以下简称“常设论坛”)由本会会同以下单位共同发起设立:最高人民法院中国应用法学研究所、中国国际经济贸易仲裁委员会、深圳仲裁委员会、石家庄仲裁委员会、广州仲裁委员会、上海仲裁委员会、上海国际经济贸易仲裁委员会(上海国际仲裁中心)和宁波仲裁委员会。
常设论坛为公益性质,旨在集合中国建设工程法律领域精英力量,通过工作组高质量调研成果,推动建设工程法律界就特定问题达成共识,提高该领域争议解决的效率和结果的可预期性,促进中国建设工程法律的完善和发展。
常设论坛内设:成员大会、发起人委员会、论坛主席与副主席、秘书长与副秘书长、工作组、专家咨询委员会、观察员及观察员委员会等。本会陈福勇副秘书长担任第一届常设论坛联席主席;丁建勇处长担任发起人代表和副秘书长。
工作组的调研、成果的宣传和推广是常设论坛的工作核心。工作组成果经成员大会表决通过以后,成为常设论坛正式成果,各成员及观察员将以适当方式予以积极推广(如召开研讨会、网站及微信推广、采纳工作组成果转化为本机构内部工作参考、支持出版发行等),使工作组成果效用最大化。常设论坛会对各成员及观察员的支持情况做跟踪了解和评估。
工作组将沿用《中国建设工程法律评论》工作组序号。首个工作组为第五工作组,已于今年2月17日成立,调研题目为《建设工程施工合同的证据规则及鉴定指引》。
成员大会对工作组调研成果进行审议和表决,对常设论坛章程修改行使表决权。成员大会每年召开三次,分别为5月、9月的第二个周六、12月的第一个周六。会议需要增减或者日期调整的,由当届主席协商决定。
自即日起,常设论坛将接受仲裁机构、法院或其庭(室)、法学研究机构和有关行业协会等机构申请作为非发起人成员,接受与建设工程有关的企事业单位、律师事务所等单位申请作为观察员,共同开展专题交流与研讨。

BAC/BIAC Cofounded the Permanent Forum of China Construction Law
and Becomes One of Its Founding Members
After half a year’s intense preparation, the Permanent Forum of China Construction Law (the “Permanent Forum”) was formally established on 14 June 2017, following the signing of its by-laws by all founding members.
Apart from Beijing Arbitration Commission/Beijing International Arbitration Center (“BAC/BIAC”), the founding members of the Permanent Forum include: the Applied Law Research Center of the Supreme People’s Court, China International Economic and Trade Arbitration Commission, Shenzhen Arbitration Commission, Shijiazhuang Arbitration Commission, Guangzhou Arbitration Commission, Shanghai Arbitration Commission, Shanghai International Economic and Trade Arbitration Commission (Shanghai International Arbitration Center), and Ningbo Arbitration Commission.
The Permanent Forum is for public purposes and not-for-profit. By organizing Working Groups to complete high quality research and through its members and observers’ campaign and promotion of the research results, the Permanent Forum aims to promote the consensus among construction law practitioners on specific issues and thereby improve the efficiency of the dispute resolution process and the predictability of the outcome.
The Permanent Forum is composed of Members’ Meeting, Founding Members’ Commission, Working Groups; Expert Consultation Commission, Observers; Presidents and Vice Presidents, and Secretaries-General and Deputy Secretaries-General. Dr. CHEN Fuyong, Deputy Secretary-General of BAC/BIAC, takes the post of the first Co-President of the Permanent Forum. Mr. DING Jianyong, Division Chief of BAC/BIAC, takes the post of the Deputy Secretary-General of and shall be BAC/BIAC’s representative at the Permanent Forum.
Organizing research and promoting the research results are the core missions of the Permanent Forum. The research results passed by the Members’ Meeting will become the official work product of the Permanent Forum and will be vigorously promoted by its members and observers in appropriate manners (for example by convening seminars, promoting through websites and WeChat, adopting Working Groups’ work product as internal guidelines of their respective institutions, supporting the publishing of such work products, etc.), so to maximize the effect of the Working Groups’ work product. The Permanent Forum will continuously follow and evaluate the members’ and observers’ support.
The Working Group will continue to use the sequence number of the Working Group of China Construction Law Review. Thus its first Working Group, established on 2 February 2017, is named the Fifth Working Group. The research topic for this group is the Rules of Evidence and Appraisal Guidelines in relation to Construction Contracts.
The Member’s Meeting of the Permanent Forum will review and decide on the research results of the Working Groups, and will exercise the voting rights with regards to any amendment of the By-Laws. The Members’ Meeting shall hold three meetings each year, on the second Saturday of May, second Saturday of September, and first Saturday of December, respectively. Any additional meeting or adjustment of the meeting dates shall be decided by the incumbent Presidents.
Since its establishment, the Permanent Forum is open to accept non-founding members such as arbitration institutions, courts, tribunals, legal research institutions and industry associations. Enterprises, institutions and law firms that are not eligible for membership but interested in contributing to the Permanent Forum may apply to become observers and participate in research and discussion.
