识别和防控建筑工程项目中的风险，对于建筑行业相关主体而言都十分重要；当工程项目位于境外时，显得更为必要。为此，北京仲裁委员会/北京国际仲裁中心（以下简称北仲）联合英国诺顿罗氏律师事务所举办“国际建设工程项目的风险防控”主题研讨会，作为北仲“名所论坛”系列活动之一。英国诺顿罗氏律师事务所国际建设工程专业团队将就大型复杂建设工程项目中所及主要风险和法律因素进行研讨，进而提出防控潜在风险的实务操作和相关建议。

本次研讨会涵括三个分议题：
一、国际建设项目风险
在投资或直接参与国际建设工程项目时，需仔细考虑诸多风险。本环节的发言将涵盖政治风险、法律监管环境、建设风险、外贸问题、支付问题和金融风险等；发言人还将就项目各方之间的风险分摊提出建议。
二、FIDIC新条款：避免争议的关键程序
2017年版FIDIC条款旨在通过使合同条款更为清晰化，回应雇主、承包商和工程师等主体的关切，以及引入争议避免程序来降低合同条款解释差异所致风险。发言人将介绍新版条款的部分变化，并就难点、索赔和争议进行解读。
三、EPC热点问题
EPC 合同并非仅涉及设施建设。每个项目都各有不同，各案合同需要谨慎起草，以平衡各方在及时交付、满足标准和后期保修等方面的利益。本环节将就EPC合同的关键考虑因素，以及有关EPC合同条款解释的典型裁判案例进行阐析。

Identifying and managing risk in construction projects is essential for any organization involved in the construction industry, particularly when the project is located in a foreign jurisdiction. Therefore, Beijing Arbitration Commission/Beijing International Arbitration Center (the BAC/BIAC) and Norton Rose Fulbright jointly hold a seminar, Managing Risks in International Construction Projects. This seminar is part of BAC/BIAC Forum for Selected Professionals. Norton Rose Fulbright’s team of international construction lawyers will discuss key risks and legal considerations involved in large-scale, complex construction projects and offer practical tools and recommendations to managing potential risks.

This seminar will cover 3 sessions:
Session One: International Construction Project Risks
When considering investment or direct involvement in international construction projects there are a number of risk areas that need to be carefully considered. This session will cover political risks, the legal regulatory environment, construction risks, foreign trade issues, payment issues and financial risks. Recommendations will be made as to how the major project risks should be allocated between the parties.
Session Two: New International Federation of Consulting Engineers Books: Key procedures for dispute avoidance
The aim of the 2017 editions of the FIDIC books was to reduce the risk of disagreement over the interpretation of contractual terms by making them clearer, clarify what was expected of the employer, contractor and engineer, and introduce procedures for dispute avoidance. This session will look at some of the changes in the new editions. It will also touch on areas of difficulty as well as claims and disputes.
Session Three: Engineering, Procurement and Construction Highlights
EPC contracts are much more than just having the facilities built. Moreover, each project is different, and careful drafting is needed to balance the interests among the parties in respect of timely delivery, achievement of the requisite standards and post completion warranties. This session will look at key considerations for EPC contracts as well as some of the cases which have been decided by the courts on how provisions in EPC contracts may be interpreted.
